Short answer: talk to the tenant within the first week, agree a written payment plan with dates, and keep a record of every reminder. If the plan fails, send a written notice that sets a final date to pay or vacate, adjust what is owed from the security deposit at checkout, and recover the rest through a legal notice and, if needed, the courts. Never cut off electricity, water or food, lock the room, or take the tenant's belongings. That turns a money dispute you would win into a complaint against you.
This guide walks through each step in order, with copy-ready messages and a timeline you can follow.
Why tenants stop paying
Knowing the reason tells you which tool to use:
| Reason | What it looks like | What usually works |
|---|---|---|
| Cash crunch | Lost job, salary delayed, parents late with money | A short written payment plan |
| Forgetting | Pays in full, but always late | Reminders before the due date, not after |
| A complaint | "I will pay when the Wi-Fi is fixed" | Fix the issue or put your reply in writing; keep rent separate |
| Planning to leave | Stops paying in the last month, expects the deposit to cover it | A clear notice-period and deposit rule, agreed at joining |
| Wilful default | Avoids calls, makes promises, never pays | Written notice, deposit adjustment, legal recovery |
Most cases are the first three. Treat them as a conversation, not a fight, and the rent usually comes in.
Step 1: Act in the first week, not the third
The longer dues pile up, the harder they are to collect. One month unpaid is a problem. Three months unpaid is often more than the deposit, and then you are chasing money from someone who has less reason to stay friendly.
- Send reminders 2 days before, on the due date, and 3 and 7 days after. Our guide to collecting PG rent by UPI has a full schedule and messages.
- By day 7, talk in person. Ask what happened and when they can pay. Do it privately, not in front of roommates.
- Write down what was said, with the date. A one-line WhatsApp summary to the tenant ("As discussed today, you will pay ₹4,000 by the 15th and the rest by the 25th") becomes your record.
Step 2: Agree a written payment plan
For a genuine cash crunch, a plan gets you more money than a fight. Keep it short and specific:
Payment plan – Room 204, Sunrise PG
Rent due for October: ₹8,000. Paid so far: ₹0.
I, Arjun Mehta, agree to pay ₹4,000 by 15 October and ₹4,000 by 25 October. November rent of ₹8,000 will be paid by 5 November as usual.
If a payment is missed, the owner may issue a notice to vacate as per the PG rules and adjust dues from my security deposit.
Signed: tenant / owner, with date
- Accept partial payments. ₹4,000 today is better than ₹8,000 "next week". Record each part and the balance.
- Apply payments to the oldest dues first, so an old balance cannot hide behind newer months.
- Give a receipt for every part payment. It protects you as much as the tenant.
- Do not let a plan run past the current month plus one. If the tenant cannot pay this month's rent and next month's too, a plan will not fix it.
Step 3: Send a written notice
If the plan is missed, put a final date in writing. In a PG this is usually a notice to pay or vacate: pay the full dues by a date, or leave by a date, as your rules and agreement allow. Send it on WhatsApp and keep a printed, signed copy.
Notice of unpaid rent
Date: 28 October 2026
To: Arjun Mehta, Room 204, Sunrise PG
Your rent of ₹8,000 for October 2026 remains unpaid despite reminders on 3, 5, 8 and 12 October and the payment plan agreed on 9 October.
Please pay the full amount of ₹8,000 by 4 November 2026. If it is not paid by then, as per clause 6 of the PG rules you accepted on joining, your stay will end and you must vacate by 30 November 2026. The unpaid amount will be adjusted from your security deposit, and any balance will be recovered from you.
Owner name, signature, phone
Keep the tone factual. List the amounts, the dates you reminded them, and the rule you are relying on. A calm notice reads well later if anyone else, a lawyer, a mediator or a court, has to look at it. More formats are in our notice to vacate letter guide.
Step 4: Use the security deposit at checkout
The deposit exists for exactly this. At checkout, deduct unpaid rent and bills, then refund the rest with a written statement of what was deducted and why.
- Do it at checkout, not mid-stay. If you use the deposit for current rent, you have nothing left for the final electricity bill or damage. Tenants who plan to leave often stop paying in the last month and say "keep the deposit". Your rules should say that the notice-period rent is payable in cash, not adjusted.
- Give a settlement statement: deposit received, each deduction with the month, and the amount refunded or still owed.
- If the dues are more than the deposit, say so in the statement and ask for the balance in writing. That message is the start of your recovery record.
See PG security deposit rules for fair deductions and refund timelines.
Step 5: End the stay the right way
Most PG residents are licensees, not tenants in the legal sense. They have permission to use a bed and shared facilities, not possession of a whole flat. Under the Indian Easements Act, an owner can revoke a licence, but the licensee is entitled to a reasonable time to leave and remove their belongings. In practice, that means written notice and a fair vacate date, as your agreement says.
For ordinary rentals (a whole flat or room let to one family), tenancy law applies instead. Where a state has adopted the Model Tenancy Act, 2021, rent unpaid for two consecutive months is a ground for eviction through the Rent Court. In other states, the state's rent control law and the courts decide. Whether a PG arrangement is a licence or a tenancy depends on the facts, so if a resident refuses to leave after notice, take legal advice before doing anything else.
What you must never do
These feel like quick fixes but expose you to police complaints, civil claims and bad reviews that cost you future tenants:
- Cutting electricity, water, Wi-Fi or food to force payment. The Model Tenancy Act specifically bars landlords from withholding essential supplies, and many state rent laws say the same.
- Locking the room or changing locks while the tenant's things are inside.
- Taking or holding belongings, documents, laptops or ID cards as security for rent.
- Using force or threats, or sending people to "talk" to the tenant.
- Shaming the tenant in a group chat or on social media, or calling their employer or college.
- Calling the police over unpaid rent alone. Unpaid rent is a civil matter. Police get involved only if there is a crime, such as cheating, threats or damage.
Step 6: Recover dues after the tenant has left
If dues remain after the deposit, these are the usual steps, from cheapest to most effort:
| Step | What it is | When it makes sense |
|---|---|---|
| Final written demand | WhatsApp and email with the settlement statement and a payment date | Always, first |
| Legal notice | A lawyer's notice demanding the amount within 15–30 days | Dues worth more than the lawyer's fee; often enough on its own |
| Lok Adalat / mediation | Pre-litigation settlement through the local legal services authority | Tenant is reachable and willing to settle |
| Rent Authority / Rent Court | Where your state has adopted the Model Tenancy Act | Tenancy, not a PG licence, in an adopting state |
| Civil suit for recovery | A money suit in the civil court | Large dues; a claim must usually be filed within 3 years |
| Cheque bounce case | Section 138, Negotiable Instruments Act | Only if the tenant gave you a cheque for rent and it bounced |
For a single month's rent on one bed, a firm final demand and a lawyer's notice are usually the practical limit. Court costs and time quickly exceed the amount. The real protection is earlier: verification, a written agreement, a deposit, and acting in week one.
How to prevent it next time
- Verify every tenant at joining: ID, address, employer or college, and an emergency contact. See our move-in checklist and police verification guide.
- Get rules accepted in writing: due date, grace period, notice period, and that notice-period rent is not adjusted from the deposit. Our PG rules template has these clauses.
- Take a fair deposit, usually one to two months' rent.
- Use one due date for everyone and remind before it.
- Look at dues every week, not at month-end.
Doing this with My PG Manager
My PG Manager keeps the record you need at every step:
- Automatic WhatsApp reminders 2 days before, on the due date, and 3 and 7 days after. Every reminder is logged with its date.
- A dues list showing who owes what and for how long, so you act in week one.
- Partial payments recorded with the balance carried forward, and a receipt for each payment.
- Checkout with open dues is blocked until you either adjust them from the deposit or write them off, so nobody leaves with unpaid rent by mistake.
- Digital agreements, rules acceptance and KYC at joining.
It costs ₹159 a month for unlimited properties and tenants after a 14-day free trial. See pricing.
Frequently asked questions
Can I cut the electricity if a PG tenant does not pay rent?
No. Withholding electricity, water or other essential services to force payment is barred under the Model Tenancy Act and many state rent laws, and it can lead to complaints against you. Use notice, the deposit and legal recovery instead.
Can I lock the room of a tenant who has not paid?
No. Locking a resident out or holding their belongings is self-help eviction and can expose you to criminal and civil action. Give written notice and a vacate date, and take legal advice if they refuse to leave.
Will the police help recover unpaid rent?
Usually not. Unpaid rent is a civil dispute. Police step in if there is a separate offence, such as threats, damage or cheating.
Can I keep the security deposit for unpaid rent?
Yes, at checkout you can deduct unpaid rent and bills, as your agreement allows. Give the tenant a written statement of deductions and refund the balance.
How long do I have to claim unpaid rent?
A civil claim for money is usually subject to a three-year limitation period. Act much sooner: the longer you wait, the harder the tenant is to find.
